Make a NO WIN NO FEE claim

Negligence Claims Advice and FAQs

I’ve already started a case with another solicitor, can I transfer it to Satchell Moran?

Yes you can. When you contact us have the details of your other solicitors to hand and we can arrange for the papers to be transferred.

What is no win no fee? Could I be left worse off?

No win no fee is just that, if your case is unsuccessful through no fault of your own then you pay absolutely nothing to any party so you will never be worse off.

Due to a change in the law back in 2013 you are now expected to make a contribution to your own legal costs if you do win and are awarded compensation – this is called a ‘success fee’. How much success fee you pay can vary but is its capped at a maximum of 25% of your award.

Again, we stress that you pay nothing at all if your case is unsuccessful through no fault of your own.

Will I have to have a medical examination?

Medical examinations are not necessary in all cases, sometimes our experts can simply review your medical records and contact you by telephone to discuss the same.

However in the majority of cases we will ask you to see a medical expert to ensure that we do not risk undervaluing your case.

Who pays for the medical experts and all of the other legal fees?

We at Satchell Moran do all of that. We fund your case and provide all of the legal advice.

If you don’t win then we don’t get paid, if we accept your case it is because we expect to win.

Will I have to go to Court?

This is a legal case so we cannot guarantee that it may not end up in Court but the vast majority of our cases settle without you ever having to go near a Court.

Do I have to bring my case within a certain time period?

Yes you do. Time limits do apply to clinical negligence cases so it is important that you contact Satchell Moran as soon as you think that some form of negligence may have occurred.

Under certain circumstances the Court can extend, or even disapply altogether, the time limits so if you are in any doubt then call us and let us advise you.

How much will I get?

How much you may get depends upon a huge number of factors such as the seriousness of the injury caused by the negligence, the recovery period, whether or not you have lost any earnings and if you need ongoing care – to name but a few.

We fully appreciate that you want to know the possible level of compensation as soon as possible so that you can decide if it is worthwhile bringing a claim. We will try our very best to give you an early and realistic valuation as soon as we begin our investigations.

Will I have to deal with loads of forms and paperwork?

There will be some forms to sign at the outset so that we can do our job. Please don’t worry, we will talk you through them all and we will send out one of our trained agents to your home address to explain them all face to face and get them signed in one go!

Ordinarily the initial sign up takes no more than 45 to 60 minutes.
